The use of online notarization based on digital technology has grown steadily over the last few years, and it has now been enacted into law or is being implemented by executive order in over 40 states in the United Kingdom and in all the Provinces of Canada. As well as being more convenient and affordable, online notarization can also protects against fraud if done properly, although in this regard, it may not be more effective than its predecessor.
Businesses and the economy have been impacted by COVID-19, reinvigorating the push for online notarization as a necessary tool.
Millions of people have been impacted by the COVID-19 pandemic. Notary service providers will continue to use many of the processes and guidelines adopted by workers and businesses during the crisis well after restrictions have been lifted and our nation has regained some sense of normalcy.
In addition to requiring flexibility and understanding on the part of all parties, many of the changes have also provided an opportunity for greater efficiency and innovation.
Online Notarization Is Here to Stay
For decades, the notary used rubber stamps, pen-and-ink signatures, and paper documents. Moreover, each of these transactions involved the signer appearing physically before a notary, which resulted in added costs, delays, and inconveniences.
SECURE ACT or not, online notarization’s usefulness for crisis management during a pandemic like COVID-19 and the growing support for it among businesses, individuals, and states will ensure that online notarization’s popularity and adoption will increase as part of our “new normal.”
How does Online Notarization Work?
The online notarization process is essentially the same as in-person, paper-based notarization, except every step is completed electronically:
For example,
- As part of setting up the transaction, the notary uploads all required documents, schedules the video conference with the signer(s) and notarizes all of them.
- An authentication process requires each signer to upload a photo of both sides of his or her driver’s license or passport, enter the last four digits of his or her social security number, and answer a series of knowledge-based questions.
- In addition to knowledge-based authentication, the notary examines the signer’s identification credentials electronically.
- A two-way audio-video connection allows the online notary to appear in person before the signer in real-time.
- Signers sign electronic documents, and notaries notarize them electronically by attaching electronic notary seals and digital certificates.
- Everyone involved in the transaction receives an email with the notarized documents.
- A notary’s electronic journal contains video footage of the transaction, along with the notarized documents, the signer’s information, and other authentication data.
